Rob Lowe’s confidentiality agreement is missing, according to his former nanny’s lawyers

Rob & Sheryl Lowe

Rob Lowe has reportedly lost the confidentiality agreement he is using as a qualifying piece of evidence in the lawsuit he has filed against a former nanny, according to her lawyers.

In April, the Lowe’s former nanny Jessica Gibson filed a lawsuit in California, alleging Lowe placed his hand inside her “pants in order to touch her crotch” and “grabbed Gibson’s buttocks without consent” several times between September 2005 to January 2008.

Gibson also alleges Lowe repeatedly exposed his penis to her, as well as frequently asking her “to touch his penis.”
Lowe counters Gibson for violating a confidentiality agreement, defamation and infliction of emotional distress.

However, in court papers filed on Thursday at Santa Barbara’s Superior Court, California, Gibson’s lawyers asked the court to dismiss the lawsuit after Lowe’s legal team revealed the document was “missing”, according to People.com.

The dismissal motion states: “In effect, Ms. Gibson has been sued for breach of a nonexistent contract. The Lowes set out to punish Ms. Gibson … and intimidate any and all who might want to assert (their rights).”

Gibson, 24, denies she was ever made to sign a confidentiality agreement before or during her time with the Lowes.

But, a source tells People.com, “Everyone who works for Rob knows that confidentiality agreements must be signed. There are plenty people who can verify that Jessica signed one. But after her employment ended, the papers went missing.”

When questioned about the “missing” document, Lowe’s lawyer Larry Stein answered, “We’ll be responding to this in court, which is the appropriate way.”

Lowe faces a lawsuit from a second nanny, Laura Boyce, who also accuses the star of harassment. A hearing on the case is set for June 19th.

Rob Lowe denies accusations in nanny’s sexual harassment lawsuit

Rob Lowe

Rob Lowe and his wife Sheryl have formally denied all accusations made against them by their former childminder after filing a response to her sexual harassment lawsuit.

Laura Boyce, who worked for the Lowe family last year, has accused Sheryl of creating an “extremely sexually offensive and hostile work environment”, claiming her ex-boss quizzed her about the size of her African-American boyfriend’s penis and regularly paraded around the family home naked.

But, in legal papers filed in Los Angeles County Superior court on Friday, the Lowes have refuted the allegations, insisting they behaved in no such manner.

They have denied every one of her accusations and have made reference to the statute of limitations, claiming Boyce waited too long before suing them.

The Lowes have also called on a judge to dismiss the case because Boyce has “unclean hands”, indicating that even if the couple behaved inappropriately towards the nanny, she has also been unprofessional and therefore doesn’t have a righteous case, reports website TMZ.com.

Lowe and his wife filed countersuits against Boyce and two other ex-employees on April 7th after claiming they’re the victims of an attempted extortion scheme, led by another former nanny, Jessica Gibson.

Rob Lowe’s deal with his chef criticized by his former nannie’s lawyer

Rob Lowe

Rob Lowe’s attempts to dismiss a lawsuit filed against his former chef will “blow up in his face”, according to the attorney representing his two ex-childminders.

The former West Wing star has been locked in a legal battle with his three previous employees since April.

Nannies Jessica Gibson and Laura Boyce have both accused Lowe of sexual harassment, while cook Peter Clements filed suit against the star and his family for wrongful termination.

Lowe and his wife Sheryl have vehemently denied all claims and hit back with their own lawsuits, claiming they’re the victims of an attempted extortion scheme, led by Gibson.

However, Lowe moved to have his accusations against Clements dropped on Friday, after the chef reportedly agreed to provide information about Gibson and Boyce to help the actor’s case against them.

But Gloria Allred, the nannies’ lawyer, has slammed Lowe’s tactics – and insists the purported deal he’s reached with Clements will do nothing to benefit his legal cases against her clients.

She tells TMZ.com, “We believe that Mr. Lowe’s latest legal maneuvre will blow up in his face and will not get him out of the hot soup that he has landed in because of the two lawsuits that we have filed against him.

“Whatever Mr. Lowe has attempted to cook up smells bad – and will leave a lasting bad taste in his attempts to go after two innocent nannies who loved and cared for his children.”

The Lowes’ suit against Clements is expected to be formally dismissed later this week.

Clements is also due to drop his accusations against the Lowes.

Rob Lowe drops his lawsuit against his former chef

Rob Lowe

Rob and Sheryl Lowe have dismissed their defamation lawsuit against their former chef, Peter Clements, after Clements provided the couple with “accurate information,” court papers say.

The Lowes sued Clements on April 7, alleging emotional distress, defamation, breach of contract and trespass. The lawsuit claimed that, when the Lowes were out of town, their former chef threw parties at their home, had sex with strangers in their bed, stole from their medicine cabinet and stole their food.

“Once Peter Clements provided Rob and Sheryl Lowe with accurate information, the Lowes willingly dismissed their claims against him without cost to either side,” the papers say.

The papers did not disclose what information he provided.

But a source close to the Lowes tells People that the couple filed the suit as part of a bigger counteroffensive after being told that Clements was backing two former nannies complaining of sexual harassment against the Lowes.

But after Clements later told the Lowes that they were misinformed, and that he had nothing to say about the nannies’ allegations, the Lowes filed dismissal papers on Friday in Santa Barbara Superior Court.

“It was a big mistake,” says a source close to the case.

Clements could not be reached Tuesday for comment.

The nannies’ attorney, Gloria Allred, says Lowe’s dismissal of the lawsuit will “blow up in his face.”

“Whatever Mr. Lowe has attempted to cook up smells bad and will leave a lasting bad taste in his attempts to go after two innocent nannies who loved and cared for his children,” she says.

Rob Lowe asks the court to dismiss some of the accusations against him

Rob Lowe

Rob Lowe is asking a Santa Barbara, California court to dismiss portions of his former nanny’s countersuit against him.

In documents released on Thursday, Lowe claims that many of Jessica Gibson’s accusations against him are “completely unfounded.”

And his attorney Larry Stein insists nine of her accusations are “subject to immediate dismissal because she has failed to even allege the essential elements of a claim of relief.”

Stein targets a number of alleged wage violations, for which Gibson countersued Lowe last month, as the items that should be dismissed.

Gibson also alleges that Lowe repeatedly exposed himself and touched her inappropriately – claims that the actor denies.

Rob Lowe’s costars love him to death

Rob Lowe

As the he-said, she-said battle between Rob Lowe and a former nanny rages on, his friends are standing firm.

“We love him to death,” his Brothers and Sisters costar Dave Annable told People Monday at the Hornitos Cinco de Mayo party in Los Angeles. “We support him.”

In regards to the legal battle, Annable added: “Rob is doing great. That’s something he doesn’t bring to work.”

The 44-year-old actor was accused of sexual harassment last month by former nanny Jessica Gibson. His wife, Sheryl, has also been accused of harassment by a second ex-nanny, Laura Boyce. The Lowes vehemently deny the nannies’ claims.

The former West Wing star has said Gibson threatened to sue unless he gave her $1.5 million. “It is an attempt to damage and humiliate not only my wife and me, but our two young sons as well,” he wrote on the Huffington Post blog. (He has filed lawsuits against both nannies and a former chef.)

Shanna Moakler stands by Rob Lowe’s former nanny

Shanna Moakler

The nanny who is accusing Rob Lowe and his wife of sexual harassment has been endorsed by reality TV star Shanna Moakler, who has vowed to stand by her.

Laura Boyce, who worked for the Lowe family up until last year, has accused Lowe of creating an “extremely sexually offensive and hostile work environment”, claiming her former boss regularly paraded around the family home naked and made inappropriate comments of a lewd nature.

She filed papers in Los Angeles on Wednesday and staged an emotionally-charged press conference with her lawyer Gloria Allred on Thursday to address her accusations.

Boyce also childminds for Moakler, who insists the 37-year-old is a good friend.

Moakler tells People.com, “I’ve been friends with Laura for the past ten years – before she was my nanny – and I completely stand by her.”

The Lowes vehemently deny all accusations levelled at them. A deposition of the actor and his wife has been scheduled for May 19th.
