Halle Berry and Gabriel Aubry are still at odds in court, as Gabriel’s attorney’s have asked the custody judge to change their agreement that requires a nanny to be present with him while he cares for Nahla in Europe.

Before Halle went to Europe to shoot her latest movie, she and Gabriel struck a deal on who gets Nahla and when, and under what circumstances.  Sources tell us one of the conditions … when Gabriel had the child, a nanny had to be present.

We’re told Gabriel is now unhappy with the deal he struck, and wants the judge to remove the nanny clause.

Gabriel’s lawyer, Gary Fishbein, argued his case this AM, while Halle’s lawyer, Neal Hersh, countered.

We’re told the judge took the matter under consideration.  A decision is expected shortly.

Halle Berry broke her foot recently during the filming of her new movie ‘Cloud Atlas’. The Oscar winner flew off for treatment and is now back in Mallorca with a walking cast.

Halle and Nahla had lunch with friends and afterwards, Berry treated her daughter to a large ice cream cone. Halle may have been in considerable pain while walking around, but she put on a brave face. And she’s going to have to! Production for the film hasn’t stopped so Halle will continue working despite the pain.

Halle Berry has to resort to unattractive wigs, because her natural hair is too dang short (I think it’s so short it’s not even cute). But neither is this wig! Is her character supposed to have really bad hair?

Cloud Atlas “contains six stories set in a different time and place that become intricately related to each other. Character details have yet to be released, but like other cast members Halle will be playing multiple roles in different storylines… In the original book there are six different threads, starting with an American notary’s boat journey home from the remote Chatham Islands, east of New Zealand, and ending in a post-apocalyptic distant future.” The author says, “All of the characters except one are reincarnations of the same soul, identified by a birthmark. The cloud refers to the ever-changing manifestations of the atlas, which is the fixed human nature. The book’s theme is predacity – individuals prey on individuals, groups on groups, nations on nations.”

In other Halle news, things seem to be going splendidly with her boyfriend Olivier Martinez.

Halle Berry has met her match in beau of one year Olivier Martinez, 45.

“He challenges her in a way that other men haven’t,” a pal says of the actress, 45, and her Dark Tide costar. And Halle digs her man’s compassionate side as well.

“He’s incredibly supportive,” says the insider. “They have a special kind of love.”

Now isn’t that special.

When I first saw the pictures, my gut instinct reacted negatively to Nahla wearing a bikini. I know a LOT of moms out there let their toddlers wear bikini’s…. it just really weird me out! A tankini? Sure – but a bikini? Aren’t our daughters growing up fast enough as it is?

The amazingly gorgeous Halle Berry spent her 45th birthday (WHAT!?) by hanging out with friends on the beach in Malibu over the weekend.

The Oscar winner also played with her daughter, Nahla. No sign of her boyfriend, Olivier Martinez.

Earlier this month, a man was arrested for harassing and stalking actress Halle Berry after he was caught allegedly scaling a wall and trying to break into Halle’s guest house at her Los Angeles home.

Halle has gotten an order that prevents the obsessed fan, Richard A. Franco, from coming near Halle and her daughter Nahla for three years. If Richard violates the agreement, the restraining order can be extended for up to 10 years.

Richard has pled not guilty to both charges of stalking and burglary.
