Michael Lohan’s ex-girlfriend — the one who got him arrested Monday — has now been busted herself … for allegedly kicking him in the head with her shoe … this according to a police report obtained by TMZ.

According to the doc, Michael Lohan and Erin Muller pulled into the driveway of his mom’s home on November 14. Michael apparently thought she was too “drunk and high” to drive and that triggered an argument. Michael says he then got out of the car and tried to keep her from driving. Lindsay Lohan’s dad says when he opened her door, Erin intentionally kicked him in the head.

Remember, Erin got Michael arrested Monday for violating a restraining order. Mr. Lohan — who knows a thing or two about revenge and jail — filed a criminal complaint of his own, and Erin turned herself in today.

Michael Lohan, the not-exactly-shy father of starlets Lindsay and Ali, was arrested yesterday on Long Island after violating a restraining order taken out by an ex-girlfriend. Despite a judge forbidding Michael Lohan from “trying to communicate by phone” with Erin Muller, he did anyway, TMZ reports. Muller sought the order in April after Lohan threatened to kill her, and himself, when she tried to break up.

Lindsay Lohan’s relationship with estranged father Michael Lohan got even uglier on Nov. 4, when Michael released a series of secretly recorded audiotapes of conversations he had with Lindsay and her mother, Dina. But now Michael is doing an about-face. “I will not release another audiotape about Lindsay,” he tells Life & Style, claiming he leaked the tapes only to pressure Lindsay — who he fears is abusing prescription drugs — into a rehab facility. “I did it because I wanted Lindsay to know how I felt when I heard that tape. When I get a phone call at 2, 3, 4 or 5 in the morning from my daughter and she’s in dire straits, I get very concerned.”

On one recording, a hysterical Lindsay claimed, “No one cares about me.” On another, Dina talked about Lindsay “cutting herself and hurting herself,” while another disturbing recording exposed the troubled 23-year-old’s apparent secret fling with Heath Ledger, who died of a drug overdose in 2008. Dina was livid after the tapes were released, saying, “The tapes were from a long time ago. For a father to stoop this low is unforgivable.”

Michael Lohan has been subpoenaed in TLC’s lawsuit against his one-time friend, Jon Gosselin, Radar Online reported.

Lohan, who may be the target of legal action himself in the coming weeks, told the site that Gosselin “did deals with [him].”

“I was working on a deal with him for a Nutrisystem endorsement and a book deal. He got paid a lot of money for different promotions, clubs, magazines, and by a TV network,” Michael claimed. “At times he said what we were doing was OK; at times he said it was a problem.”

Lohan also alleged that his former friend was paid in cash for many appearances. The pair were formerly planning a reality show called the “Divorced Dad’s Club,” which fell apart in recent weeks.

Gosselin is being sued for breach of contract by TLC. The status of his show with the network, “Jon and Kate Plus 8″ (which the cable channel announced in September was set to be renamed “Kate Plus 8″), remains up in the air.

As previously reported on AccessHollywood.com, a judge granted motions for the network’s lawyers to depose Lohan, along with Hailey Glassman and members of Gosselin’s staff.

Gosselin’s lawyer previously told Access the allegations were a “baseless action.”

As for Lohan’s own possible legal drama, daughter Lindsay’s lawyer, Shawn Chapman Holley, previously told Access that reports that the young star would file a cease and desist or restraining order against her outspoken father were “not true.” However, mom  Dina Lohan told Access Hollywood‘s Billy Bush on Monday that her other daughter, Ali, would be seeking a restraining order against her father.
