Police: Lane Garrison Drunk, on Drugs in Fatal Crash

Prison Break actor Lane Garrison had cocaine and more than twice the legal blood alcohol level in his system after a fatal car crash last month and should be charged with felony vehicular manslaughter, police said Wednesday.

Garrison, 26, was involved in an accident that killed a 17-year-old male passenger. Two 15-year-old girls, who were also in the car, were both injured – one critically.

Beverly Hills police turned over the case to the Los Angeles County District Attorney’s Office, but no decision has been made about whether Garrison will be prosecuted.

“We’re reviewing it now,” says DA spokeswoman Jane Robison.

At a press conference Wednesday, Beverly Hills police said Garrison’s blood alcohol level was .20 percent – more than two times California’s .08 percent limit. He also had an undisclosed amount of cocaine his system, according to a blood test.

Police recommended that he be charged with gross vehicular manslaughter with an enhancement for causing injury or death to more than one victim. Police also recommended he be charged with contributing to the delinquency of a minor.

If convicted of the most serious charge – gross vehicular manslaughter – he faces 10 years in state prison. The other charges would add additional years to the term.

Major development in the Lane Garrison case.

There is an important development in the Lane Garrison case. The Beverly Hills police will conduct a news conference at 4:00 PM today. TMZ has now learned the police have sent the Garrison case to the Los Angeles County District Attorney for possible criminal prosecution. The D.A. must now decide whether to prosecute the “Prison Break” star for felony vehicular manslaughter.

Garrison’s blood alcohol level has now been determined. Sources tell TMZ the actor’s blood alcohol level was “high.”

Garrison was behind the wheel when his Land Rover crashed into a tree in Beverly Hills on December 2, killing 17-year-old Vahagn Setian.

As TMZ first reported, Garrison met Setian and two 15-year-old girls hours before the crash. The teens invited the actor to a party. People who attended the party tell TMZ they saw Garrison drink between four and seven shots of Grey Goose vodka in a short period of time.

Garrison’s high-powered celebrity defense lawyer, Harland Braun, tells TMZ his client was heading back to his apartment when the crash occurred.

First look at Lane Garrison since this weekends fatal crash.

An emotional Lane Garrison was seen weeping and looking very distraught as he left a Los Angeles area church.

Garrison was the driver in a weekend accident that killed 17-year-old Vahagn Setian and seriously injured two other teens. He exited Good Shepherd Church in Beverly Hills with tears streaming down his face and his head in his hands.

The “Prison Break” actor showed up to the church at 11:30 Wednesday morning, spending 15 minutes inside before his tearful exit.

Lane Garrison did “several shots” before fatal crash.

TMZ has exclusively learned that Lane Garrison drank “several shots” of Grey Goose vodka at a party before driving a Land Rover that crashed in Beverly Hills, killing 17-year-old high school student Vahagn Setian and injuring two 15-year-old girls. This contradicts the account of Harland Braun, Garrison’s attorney, who told TMZ that the “Prison Break” star had consumed only one drink at the party, and that he doubted that Garrison was intoxicated when he took the wheel.

Five eyewitnesses from the party tell TMZ that Garrison arrived at the party with Setian and two women, whom he had met earlier at a gas station. They say Lane brought a bottle of Grey Goose vodka to the party and unveiled the bottle to the crowd with a flourish. The gathering was described by several attendees as a “kick back of around 30 people.” The eyewitnesses, all acquaintances of Setian, say that Garrison then started taking shots of the vodka and offering shots to other partygoers. Several eyewitnesses also said photographs were taken of Garrison consuming alcohol.

Later in the evening, when the alcohol at the party was running low, the eyewitnesses say that Garrison agreed to drive out to buy more, and took Setian and two girls with him. Four hours elapsed, they say, before they became concerned and drove out to look for Garrison, Setian and the young women. After discovering the accident, they then drove to Cedars-Sinai Medical Center, where they learned that Setian had died.

Attorney Harland Braun tells TMZ that ultimately the results of Garrison’s blood alcohol test could tell the story. The results of that test are two weeks away.

UPDATE: Why Lane Garrison was with the teenagers.

TMZ has learned that “Prison Break” star Lane Garrison has hired powerhouse defense attorney Harland Braun in connection with last Saturday’s fatal car accident.

Lane was at the wheel in his Land Rover on Saturday night when it crossed a median in Beverly Hills and crashed into a tree. A 17-year-old boy sitting in the backseat was killed and two 15-year-olds were injured. Braun tells TMZ that Garrison had never met the three teenagers before the night of the accident. Braun says Garrison was at a local supermarket earlier in the evening when the trio recognized him in the checkout line and asked him if he wanted to go to a party. Braun says Garrison went to the party and had one drink.

Braun says Garrison also had one margarita at a Mexican restaurant that night, but that was the extent of his alcohol consumption. Braun tells TMZ that as Garrison was leaving the party to meet a woman at his apartment, the three teens asked to accompany him. Braun says Garrison has no recollection of the accident, which Braun says rendered him unconscious. In fact, Braun claims Garrison’s first memory was waking up at the Century City Hospital emergency room with a taxi coupon on his lap that had been given to him by hospital staff so he could get home.

Braun says he was not told by hospital personnel that someone had died. He learned of the death later from a friend, Braun says, and was “totally despondent.” Braun says a sample of Garrison’s blood was taken at the hospital, but it could take several weeks before the results are in. Braun says he doubts Garrison was intoxicated, but also says, “Who knows if someone put something in his drink at the party.”

Braun also says Garrison’s Land Rover had been experiencing alignment issues as of late and had been pulling to one side, and added that the SUV had brake problems. Braun says he is forwarding repair receipts to the police.

According to Braun, “Nobody knows what happened, it’s a mystery.”

Prison Break star Lane Garrison was behind the wheel in a weekend car crash that left a teenager dead, police said.

The 26-year-old actor, who played Tweener on the Fox drama, was driving two 15-year-old girls and a 17-year-old boy in his SUV Saturday night, when the vehicle jumped a curb and hit a tree in Beverly Hills.

Garrison escaped the crash with minor injuries. Both girls were also said to be injured—one critically. The teenaged boy was taken to Cedars-Sinai Medical Center, where he was pronounced dead.

Police said Monday that Garrison appeared to have been drinking before the crash, but that he was not immediately arrested at the scene.

“Mr. Garrison displayed symptoms of alcohol intoxication and the investigation into Mr. Garrison’s impairment is ongoing,” Beverly Hills Police Lieutenant Mitch McCann said in a statement Monday. “In addition to noting Mr. Garrison’s symptoms, investigators also removed alcohol containers from the SUV, which was registered to Mr. Garrison.”

Because they were underage, none of the teens were identified. About 50 mourners gathered at the site of the accident Sunday night, bearing candles and flowers.

On hearing of the accident, Jessica Simpson, who grew up with Garrison in Texas, issued a statement on her family’s behalf.

“We love Lane very much and our thoughts and prayers are with him now,” Simpson said through her rep.

It was the second car accident involving Garrison in recent weeks. While leaving a Los Angeles hotspot in October, he hit another car at a stoplight in an incident captured by paparazzi cameras. (Video of the fender-bender is online at TMZ.com.)
