
Kiefer Sutherland will not be prosecuted for an alleged head-butting incident in May.
The case against the 24 star has been dropped, according to the New York District Attorney, who rejected the case, according to Entertainment Tonight.
“We declined to prosecute after a full investigation,” the D.A. said Tuesday in a statement. “And that included speaking to the complaining witness who was quite uncooperative… Therefore, the D.A. declined to prosecute.”
Sutherland and the designer he is accused of head-butting had previously announced that they had resolved their differences, clearing the way for the charges to be dropped.
Sutherland, 42, is also clear with the L.A. City Attorney’s office, which investigated the actor for a possible probation violation. (He is currently serving a five-year probation term following a DUI conviction in 2007.)
The actor was charged with third-degree assault after he allegedly bashed heads with Proenza Schouler’s Jack McCollough, who accidentally bumped into Brooke Shields at a Met Gala after-party May 5. Multiple outlets reported that Sutherland was intoxicated.

Kiefer Sutherland has been charged with assault for allegedly headbutting women’s wear designer Jack McCollough after a boozy night at a local club, Usmagazine.com confirms.
New York police said the charges were filed after he spoke to investigators Thursday, the Associated Press reports.
The 24 star — who is scheduled to start filming the eighth season in late May — arrived at a New York City police station for questioning on Thursday, two days after the incident. He arrived in a Lincoln Town Car with his lawyers. He did not speak to reporters as he entered the precinct house in lower Manhattan.
“Kiefer is here, he walked in a few minutes ago,” an officer told Us.
Sutherland, 42, was talking to Brooke Shields at a Met Gala after-party when McCollough accidentally bumped into the actress. Sutherland, who appeared intoxicated, then demanded the designer apologize.
McCollough claims Sutherland attacked him after the argument, leaving him with a cut on his face. Detectives also may question actress Brooke Shields as a witness.
This isn’t Sutherland’s first booze-related mishap.
He was arrested in 2004 for DUI and, again, in 2007. In the 2007 case, he pleaded no contest to the DUI charge and was sentenced to 48 days in jail. It’s unclear whether the charges will affect his probation status.

Kiefer Sutherland will face a misdemeanor assault charge as a result of the incident earlier this week. Kiefer allegedly headbutted, without provocation, fashion designer Jack McCollough when the two attended a party after the Met ball in Soho.
Jack claims it was unprovoked, while Kiefer claims he did so only after Jack pushed actress Brooke Shields. This might complicate legal matters for Kiefer as he is currently on probation for DUI, which he was charged with in 2007.
Kiefer is expected to surrender to police at some point today, but there are some complications regarding residency and the procedure to arraign him.

According to multiple published reports, Kiefer Sutherland allegedly headbutted women’s wear designer Jack McCollough after a boozy night in New York City early Tuesday morning.
New York’s Daily News reports that Sutherland, 42, was talking to Brooke Shields at a Met Gala after-party when McCollough accidentally bumped into the actress. Sutherland, who appeared intoxicated, then demanded the designer apologize.
“Sutherland was really drunk,” another witness tells the New York Post. “They started arguing and then he just head-butted him.”
McCollough’s injuries remain unknown, but TMZ reports he suffered lacerations on his nose.
Reps for Shields tell TMZ that McCollough “did nothing inappropriate. It’s not clear what caused Kiefer to do what he did.”
Police are currently investigating the incident.
This isn’t Sutherland’s first booze-related mishap.
He was arrested in 2004 for DUI and, again, in 2007. In the 2007 case, he pleaded no contest to the DUI charge and was sentenced to 48 days in jail.
At the time, he said, “I’m very disappointed in myself for the poor judgment I exhibited recently, and I’m deeply sorry for the disappointment and distress this has caused my family, friends and co-workers on 24 and at 20th Century Fox.”

The ‘24′ star claims he can’t seem to stop marking important events in life with a new tattoo.
He says he got his first tattoo at 16, and says that since the first one he’s been unable to stop. He claims that anytime he went through ‘anything that mattered’ in his life he would honor it with a new piece.
“I have a lot. There are times when it is difficult. When I work I have them covered up and sometimes see a picture of myself when I had none and think maybe I shouldn’t have had any. But most of the time it’s a nice map for myself about the journey of my life.”

Kiefer Sutherland spent seven weeks behind bars earlier this year for a second DUI conviction and for violating probation. The “24″ star has since remained tight-lipped about his incarceration, and press have been strictly warned not to approach the subject. But Sutherland has (finally) opened up about the ordeal.
“There’s no smoking. The lights never go out, 24/7. You can’t cover anything. You can’t even put your head under a blanket. All the cells have cameras in them,” the 41-year-old actor lamented to the upcoming issue of “Men’s Vogue.”

Kiefer Sutherland has confessed he doesn’t deserve the millions he earns for his profession.
The 24 star believes actors are paid too much for their job and admits those working in the emergency services are more deserving of the money.
He says, “The kind of money generated around the industry is way out of proportion. The admiration bestowed on actors is also out of perspective. Doctors are the stars of our society – people like my grandfather who was responsible for the health care in Canada – as well as teachers, firefighters and police officers.”
