Kevin Federline has filed an order to show cause for primary physical custody of his two sons with ex-wife, Britney Spears, according to a source.
The documents were filed in Los Angeles Superior Court on Wednesday by Federline’s lawyer, according to the source.
Spears and Federline’s divorce was finalized less than two weeks ago. At the time, the couple agreed to split custody 50-50 of Sean Preston, 22 months, and Jayden James, 10 months.
But a source close to Federline told PEOPLE that the would-be-rapper was worried Spears was exposing the boys to “unnecessary risk” and that his lawyer, Mark Vincent Kaplan, “hopes to get Kevin primary custody.”
In June, when the couple were wrangling over their divorce settlement, Federline was still resisting signing the papers over growing concerns about Spears’ erratic behavior.
Spears, who spent a stint at Promises rehab center, has been a fixture on the nightclub and party scene. The news of Federline’s request for primary custody comes as photos have surfaced of his ex-wife reportedly topless in a hotel pool.
Calls to Spears’s lawyer were not immediately returned.

Just minutes ago, Spears’ lawyer, Laura Wasser, and K-Fed’s mouthpiece, Mark Vincent Kaplan, walked into court — final papers in hand — to get a Los Angeles County Superior Court judge to sign-off on the settlement, making the divorce final.
We’re told Wasser will make a motion to keep the custody and spousal support orders secret.
Here’s what TMZ knows: K-Fed is pulling in 15K a month from Britney for child support. He’s also getting 20 grand a month in spousal support, but that’s based on the prenup, and it appears the alimony gravy train will come to a screeching halt in November.
As for custody, we’ve learned it will stay at 50/50. It’s amazing disso-queen Wasser was able to get a 50/50 custody split given Brit’s craziness, which included wild partying, erratic behavior and a stint in rehab. This type of custody arrangement is typically reserved for a stable couple.
But all is not over! We’re told neither Brit nor Fed-Ex are happy with the custody arrangement, and either of them can go back to court and ask for a change. On top of that, Kevin won’t even speak to Spears, so they will probably be back in court asking the judge to make decisions about child rearing.
One more thing: There are reports K-Fed will go to court as early as this week to get full custody. That doesn’t make a lot of sense, since our sources say K-Fed has signed-off on the 50/50 custody split. He may not be happy, but it doesn’t seem he’s ready for all-out war either.

Crushing news for romantics hoping Britney Spears and Kevin Federline will re-unite: K-Fed has a new sweetie.
The aspiring rocker has been dating Los Angeles hip-hop radio personality Liz Hernandez, according to the National Enquirer.
“Kevin is definitely thrilled with Liz,” a source told the tab. “He talks about her all the time — how smart she is, how she’s marketed herself so well, and how beautiful she is. He’s serious about her.”
The two first met about 18 months ago when the aspiring rapper appeared on Hernandez’s radio show. In an exchange that caused a hubbub at the time, she asked Federline who was better in bed, Spears or his ex, Shar Jackson. Spears was said to be furious because he didn’t say her name immediately.
“Liz is trying to keep [the romance] quiet because she doesn’t want it to get around work, but Kevin can’t help but brag about his conquest to his friends and family,” the source told the Enquirer. “He has tons of modeling pictures of Liz in his home. She likes to cook, and Kevin loves that because he always did the cooking for both Shar and Britney,” says the source, who adds that Hernandez thinks Federline’s two children by Spears are “adorable.”

Meanwhile, Spears’ ex, Kevin Federline, apparently doesn’t have what it takes to be a reality-show star.
K-Fed has been in talks with a number of networks — reportedly including Fox and MTV — about making his life as a single dad into a show.
“The show will show him for who he is but [will] not smear [Spears],” executive director Kenneth Crear had said when the show was in the developmental stages. “It was just a marriage that didn’t work out, but it will show who he is beyond that.”
Apparently, “beyond that” is just too boring. “His life just isn’t wild enough to make a great show,” a source tells Us.
