Court Orders Kevin Will Keep Custody of Kids

Lawyers for Britney Spears and Kevin Federline were in court Wednesday for the second hearing of the week regarding custody of the former couple’s two sons, Sean Preston, 2, and Jayden James, 1. While Spears received the news at her Beverly Hills home, Federline (wearing a patch over one eye) was present in court when Judge Scott M. Gordon ruled to uphold his October 1 decision to grant Federline full custody until further court order.

Spears has been given visitation rights, but Usmagazine.com has learned that she will have to be supervised.

While leaving the courtroom, Spears’ attorney Sorrell Trope told reporters, “I’m not going to say anything. It’s totally inappropriate from my perspective to make comments on an active case without my client’s expressed consent, and she is not here.”

Meanwhile, Federline’s lawyer Mark Kaplan told the press, “The orders were justified and [Kevin]’s pleased with the orders in place.”

The October 1 decision was due to Spears’ inability to produce a valid driver’s license and failure to submit to a drug test. The tests are a condition of the couple’s shared custody agreement, along with mandatory counseling and parenting classes.

In an effort to regain custody, Spears got her California license (she had been licensed in Louisiana) on Tuesday, and had friend Sam Lutfi arrange a drug test. Lutfi told Usmagazine.com, “[Britney] is hoping the judge will reverse the order Wednesday, now that she is making steps to follow through with what they asked.”

Though Federline’s court ordered custody did not go into effect until noon today, Spears dropped the children off with him on Monday afternoon, before heading to a tanning salon.

Both Spears and Federline must be present at the next hearing, on October 26.

Kevin Federline Britney Trouble

Life & Style has learned exclusively that Kevin Federline’s lawyer, Mark Vincent Kaplan, is heading to LA Superior Court this morning to allege that Britney Spears was driving without a license over the weekend while her children were in the car!

Kaplan’s appearance this morning will be the latest move in Kevin and Britney’s ongoing custody battle over their sons Sean Preston, 2, and Jayden, 1. Insiders say Kaplan will also bring up Brit’s driving without a license on Aug. 6, when she was involved in an alleged hit-and-run motoring offense after crashing into a parked car in the San Fernando Valley.

Insiders tell Life & Style that Kaplan held an hour-long, closed-doors meeting with Commissioner Scott Gordon on Sept. 28, in which it’s understood that Kaplan discussed the alleged hit-and-run offense. At the time of the incident, Britney reportedly drove away from the scene, and it emerged that she did not have a California license when the owner of the other vehicle reported the crash to the police. If convicted of the offense, Britney could face up to six months in jail plus $1,000 in fines!

Meanwhile, Britney could face more legal trouble if she fails a court-ordered, random drug test, administered twice weekly. Lynn Soodik, a Santa Monica, Calif., based family attorney not involved in Britney’s case, tells Life & Style, “If she fails a drug test, the court might try monitored visitation, or no visitation until the tests come back clean. The court would be trying to protect the children.”

Brit’s rep couldn’t be immediately reached for comment.

Who thought Kevin Federline was going to come out of this whole mess being the sane, responsible one with a career? Not me. But then again, I’m wrong about everything all the time.

Spears Keeps Shared Custody of Kids

Britney Spears may have lost her lawyer and her manager, but she’s keeping her kids.

Mel Goldsman, an attorney at Freid and Goldsman, where Spears’ new lawyer Marci Levine works, tells The Insider that yesterday’s hearing affirmed Spears and Federline’s joint custody agreement.

This news comes despite new claims from a touted “mystery” witness, former Spears bodyguard Tony Barretto, that even after her February stint in rehab, Spears was using drugs. Barretto joins a long list of former Spears employees who may testify against her in the upcoming custody battle, from bodyguard Daimon Shippen to assistant Shannon Funk.

Is someone trying to kill poor KFed?

ET has several reliable sources that the FBI and LAPD are investigating legitimate leads on a contract hit on Kevin Federline’s life.

Multiple sources tell ET that the FBI made attempts to contact Federline to inform him of the potential danger.

Sources within the FBI tell ET that this is the bureau’s standard operating procedure when someone’s life is threatened.

ET has been working this story for the past two months. When contacted, the FBI told us that the bureau cannot confirm or deny an investigation.

While Britney was out for the LAX opening on September 1st, K-Fed was in Arizona at the Jackrabbit lounge. So, both parents are out and about, who’s watching the children? Do either of these two actually stay at home?

Britney & KFed officially divorced today!

Britney Spears and Kevin Federline will officially divorce today.

Just minutes ago, Spears’ lawyer, Laura Wasser, and K-Fed’s mouthpiece, Mark Vincent Kaplan, walked into court — final papers in hand — to get a Los Angeles County Superior Court judge to sign-off on the settlement, making the divorce final.

We’re told Wasser will make a motion to keep the custody and spousal support orders secret.

Here’s what TMZ knows: K-Fed is pulling in 15K a month from Britney for child support. He’s also getting 20 grand a month in spousal support, but that’s based on the prenup, and it appears the alimony gravy train will come to a screeching halt in November.

As for custody, we’ve learned it will stay at 50/50. It’s amazing disso-queen Wasser was able to get a 50/50 custody split given Brit’s craziness, which included wild partying, erratic behavior and a stint in rehab. This type of custody arrangement is typically reserved for a stable couple.

But all is not over! We’re told neither Brit nor Fed-Ex are happy with the custody arrangement, and either of them can go back to court and ask for a change. On top of that, Kevin won’t even speak to Spears, so they will probably be back in court asking the judge to make decisions about child rearing.

One more thing: There are reports K-Fed will go to court as early as this week to get full custody. That doesn’t make a lot of sense, since our sources say K-Fed has signed-off on the 50/50 custody split. He may not be happy, but it doesn’t seem he’s ready for all-out war either.
