Jamie Lynn Spears’ pregnancy, at age 16, has raised legal questions because of Casey Aldridge’s age.

Aldridge is believed to be 18 or 19.

There is still no word on where the sexual intercourse took place.

However, if it happened in Spears’ home state of Louisiana, and if Aldridge was 19 at the time, he could be charged with what the state calls “felony carnal knowledge of a juvenile,” which is defined as “sexual intercourse with consent between someone age 19 or older and someone between age 12 and 17.”

If he was under 19, then he might be charged with a misdemeanor. Laws vary from state-to-state.

A spokeswoman for the local sheriff’s department in Kentwood, Louisiana, told Baton Rouge’s WAFB-TV that no complaint has been filed in the case and “no criminal investigation is currently underway.”

There’s more baby drama for pregnant Jamie Lynn Spears!

A day after news broke that the 16-year-old is expecting, a Spears family insider tells Life & Style that she and Casey Aldridge, the father of her baby, are not seeing each other!

“Jamie Lynn and Casey are NOT together. They’ve broken up numerous times, but he was her first and she kept taking him back,” says the insider.

“They’re not dating now. He’s really got nothing to offer this baby. He’s a kid himself. They have no plans to get married.”

“At this point, Jamie Lynn has asked her mom — and not Casey — to be in the delivery room with her.”

A rep for Jamie Lynn was not immediately available for comment.

The Spear’s family seems to like Casey Aldridge. According to the family, he has been the ”buffer” between Hollywood and it’s pressures. 

“He took amazing care of Jamie Lynn,” a source close to the family says. “Anything ever went wrong, he always comforted her. He took care of her.” 

Aldridge, who is believed to be 18 or 19, has stayed largely out of the Hollywood spotlight, only occasionally accompanying Jamie Lynn to Hollywood events.

He grew up in Liberty, Miss., about 30 miles from the Spears family home base in Kentwood, La., and played high school baseball and football (he’s listed in a sports directory as a lean 6′1″, 165 lbs).

Recently, he has lived in Southern California and was a fixture at the condo where Jamie Lynn stayed with her mother, Lynne, while filming the Nickelodeon series Zoey 101. Aldridge drove her to the Valencia set, near Los Angeles, every day and stayed there while she worked, impressing Lynne and Jamie Lynn’s father, Jamie.

“Jaime talks about how he really likes Casey because he’s a great guy,” the Spears family source says. “Lynne really likes him, too. He’s a good kid, cares a lot about Jamie Lynn. They both adore Casey.”

The pregnancy, a source close to Aldridge says, was a surprise.

“I’m sure it was a shock to him,” the source says. “He has all sorts of plans for his future. He wants to start his own business, maybe get a degree and make something of himself.”

The source says that Aldridge will take responsibility for his actions.

“He’s a stand-up guy, and he will take care of the baby,” the source says. “He is not the type to let her deal with it on her own. He will be there in any way he can. … I know a baby wasn’t in his plans for right now, but he’ll do what he has to do, and he’ll be a good father. He really will.”

Britney isn’t the only Spears surprised by Jamie Lynn’s pregnancy.

Their father Jamie is “furious” with Jamie Lynn and ex-wife Lynne for selling the story of her pregnancy to OK! magazine, a source close to the family tells Usmagazine.com.

Jamie Lynn and Lynne broke the news to OK! – infamous for multi-million dollar payouts to celebrities – for an unspecified amount.

“He put his foot down and refused to take any money and ‘profit off of his children,’” the source says. “Lynne didn’t care.”

Jamie is “devastated” by the news, says the source. He’s “extremely depressed” and “feels Jamie Lynn ruined her life.”

TMZ has learned that Jamie Lynn Spears was not paid for this week’s magazine interview … yet. We’re told the money will change hands down the road — when the baby is born.

Just how did the deal go down? Rewind. Sources close to Britney’s family tell TMZ it all started when Britney melted down on an OK! Magazine photo shoot. Britney’s mom, Lynne, read the article (who didn’t?!) and called OK! personally to thank them “for handling it so well.” She stayed in touch with OK!, and called them this week when she learned that news of Jamie’s pregnancy was about to break. Her only requirement? Keep Britney out of it. This is about Jamie Lynn. “She trusted them to do it in a way that would be sympathetic to her daughter,” our source says.

We’re told Jamie and mom did not want money, but OK! has agreed to pay $1 million to the younger Spears for a photo shoot when the child is born. Why so little when others have commanded several million? We’re told it’s because Jamie Lynn is not an international star and it’s not worth it to the mag to pay big bucks for something they can’t sell overseas.

Another interesting note: We hear Jamie is further along than the 12 weeks she says in the mag’s article. Expect a spring baby.

Also, what will become of Zoey 101?

Decisions, decisions. Keep Zoey 101 on the air, even though series lead Jamie Lynn Spears is now the poster girl for teenage pregnancy, or pull one of cable’s most popular youth-targeted series as a PR tactic? Nickelodeon thus far is opting for Plan A and sticking with its schedule to broadcast the remainder of Zoey 101’s fourth and final season, which had wrapped production in September, says the Reporter.

As Whoopi Goldberg pointed out on Wednesday’s The View, “Her character is her character, who she is who she is. This might be a discussion to have later, separating the people from the characters.”

Britney Spears may have been kept in the dark about sister Jamie Lynn’s pregnancy, but she certainly seemed unfazed Tuesday night as stepped out for some shopping at the Lisa Kline Boutique.

“She called us in the early evening and said she wanted to come shop for Christmas,” the store’s rep, Kate Diamond, tells People. “She looks the best I’ve seen her in a really long time … She was really, really nice, saying, ‘Thanks, babe,’ ‘Yeah, babe.’ Everything was ‘babe.’”

Perhaps she had babies on the brain. After all, Spears, the 26-year-old mother of two, had just recently learned that her 16-year-old sister is 12 weeks pregnant.

“[Spears] bought her mom and her sister Christmas gifts, matching gifts,” Diamond said, adding that the pop star also snapped up two By Francine dresses and a Treesje purse for herself.

Given the crowd of paparazzi outside, the store also had security on hand. In an odd twist of fate, IMF’s Aaron Cohen – the man hired by Kevin Federline’s attorney, Mark Vincent Kaplan, to subpoena several of Spears’s associates – was this time charged with protecting the singer.

“That’s how we do it,” Cohen told People. “Whatever our prior engagements might be – safety first.”

Cohen said that Spears was “so sweet.” As for her mood, “She was good, cheery, uppy.”

After her shopping spree, Spears ducked into a dressing room and pulled her patented wardrobe switcheroo – changing from jeans into a new short red dress.

The singer and her assistant then drove a few blocks to the nearby Raffles L’Ermitage hotel, where they spent a few minutes at the bar drinking water, soda and coffee before being escorted upstairs.

As the singer was getting in to the elevator, a fan commented on how good she looked in the dress, then asked how her sister is doing. Spears smiled and responded, “Jamie Lynn is good!”

Sources are reporting that Jamie Lynn Spears has confirmed her pregnancy to OK! Magazine.

A source tells us the interview, which hits stands tomorrow, is six pages and is on the record with Jamie Lynn and her mother. She tells the mag that the father is Casey Aldridge, who she has been dating for some time and first met at church. Brit’s younger sister, star of Nick’s “Zoey 101,” says she’s keeping the baby.

Sources tell us that she has not yet told her older sister.

Nickelodeon issued the following statement this afternoon: “We respect Jamie Lynn’s decision to take responsibility in this sensitive and personal situation. We know this is a very difficult time for her and her family, and our primary concern right now is for Jamie Lynn’s well being.”

Britney Spears’s 16-year-old sister Jamie Lynn Spears is pregnant.

Spears and her mother confirmed the pregnancy to OK! magazine, saying she was 12 weeks along and the father is Jamie Lynn’s longtime boyfriend Casey Aldridge. Aldridge’s mother confirmed it to TMZ.com.

“It was a shock for both of us, so unexpected,” Jamie Lynn told OK!, according to the Associated Press. “I was in complete and total shock and so was he.”

Spears told the magazine that after confirming the pregnancy with a home test and a subsequent doctor’s visit, she told only one friend – then waited two weeks before telling anybody else, including her parents.

“I needed to work out what I would do for myself before I let anyone’s opinion affect my decision,” she told the magazine. “Then I told my parents and my friends. I was scared, but I had to do what was right for me.”

She told her parents just before Thanksgiving.”I didn’t believe it because Jamie Lynn’s always been so conscientious,” her mother, Lynne Spears, told OK!. “She’s never late for her curfew. I was in shock. I mean, this is my 16-year-old baby.”

Aldridge’s mother, Joyce Aldridge, told TMZ she was “aware of the recent interview regarding her and being pregnant” and that “we are in agreement with everything that was said by Jamie Lynn.”

“Everything is fine,” Joyce Aldridge added.

Spears, a high school junior who is 10 years younger than Britney, had until now escaped much of the attention about her personal life that has surrounded her sister.

Jamie Lynn stars as a schoolgirl at the fictitious Pacific Coast Academy in Zoey 101, finishing its third season next month as one of Nickelodeon’s highest-rated shows.

A rep for Spears was not immediately available for comment.
