TMZ has learned Heather Locklear was arrested yesterday on suspicion of driving while impaired.

Locklear was pulled over while driving in the Santa Barbara area.

Law enforcement officers tell us alcohol was not involved, however, they are conducting tests to determine if Locklear was under the influence of drugs.

We’re told she was released on her own recognizance, without having to post bail.

This could set up a bizarre custody battle given that Locklear and ex-hubby Richie Sambora have both been busted for similar charges.

Sambora pleaded no contest to DUI back in March — his daughter Ava was in the car at the time he was popped. We’re told Heather’s kids were not in the car when she was arrested.

In June, Heather checked herself into an Arizona medical facility to fight anxiety and depression.

“Heather’s feeling really great,” says a close friend. “And she looks beautiful, just radiant.”

While the actress’s recovery is “a work in progress,” Locklear seems rejuvenated by her month away, says the friend. “She told a really funny story and she laughed from her core,” says the pal, who has seen Locklear since she returned home last weekend. “That’s when I knew she was going to be fine. I think that’s the best part of all – it’s so nice to hear her laugh.”

During her time at the Arizona facility, Locklear, 46, remained under doctors’ care while getting therapeutic spa treatments, riding horses and spending quality time alone. Her spirits were lifted by two visits from boyfriend Jack Wagner.

Since she checked herself in on June 19, Locklear has enjoyed the support of her ex, Bon Jovi rocker Richie Sambora. Their daughter Ava, 10, spent the last few weeks with Sambora but is now with her mom. Locklear is most excited, says the source, to be “back home with Ava.”

On June 19, Jack Wagner, 48, showed his devotion to Heather Locklear by driving her to Arizona for treatment at the Sierra Tucson rehab facility. Once she completes her inpatient program, he wants to prove his love again — by asking her to be his wife!

“Jack wants to marry Heather as soon as her issues are under control. He’s already spoken to her therapists,” a friend reveals, noting that Heather will surely say yes. “After Jack came to visit, she realized how in love they are,” the pal says, adding that Heather would love a small beach wedding.

The 46-year-old actress, who divorced rocker Richie Sambora in April, was scheduled to check out of the rehab facility on July 16, another insider reports. “Her extended treatment plan is being worked out now,” the insider says. “Heather says that Jack is the best thing in her life next to her daughter,” the actress’ pal tells In Touch.

Heather Locklear “is doing great” in rehab, according to her partner Jack Wagner.

The Melrose Place star entered an in-patient facility in Arizona last month to seek help for anxiety and depression.

Wagner, who had not seen Locklear since she left Los Angeles for Arizona on June 19th, surprised the 46-year-old with a lunch date on Sunday.

He tells Usmagazine.com she is doing well.

They’re no longer together, but Heather Locklear can still count on her ex-husband Richie Sambora.

As Locklear, 46, seeks treatment for depression and anxiety at an Arizona facility, the Melrose Place star has Sambora firmly in her corner, says a friend of the couple, who have a 10-year-old daughter, Ava.

“Without a doubt, he’s there for his daughter and her mother,” a friend of the Bon Jovi guitarist tells People. “They may be divorced, but they are raising a little girl they both love very much.”

Sambora, who split from Locklear in 2006 after 12 years of marriage and subsequently dated Locklear’s former friend Denise Richards, is currently performing with Bon Jovi in England until June 28. The band is due to finish their tour in the U.S. with a few East Coast dates in July.

Although he’s on the road, “I’m sure he’s available if Heather should need something and certainly for Ava,” says the pal.

Heather Locklear has entered rehab for psychological treatment, her rep confirms to Usmagazine.com.

“Heather has been dealing with anxiety and depression. She requested an in-depth evaluation of her medication and entered into a medical facility for proper diagnosis and treatment,” the rep said in a statement. “This is a confidential medical matter and no further statement will be released.”

In March, TMZ.com reported that a pal called 911, fearing Locklear, 46, was suicidal.

The actress — who recently filmed the Lifetime movie Flirting with 40 — has a daughter, Ava, 10, with ex husband Richie Sambora. (He began dating her ex-friend Denise Richards after splitting with Locklear. He was arrested for DUI in March.)
