Earlier today it was reported that Halle Berry was looking to move to France with her daughter, and we all assumed it was because that’s where her boyfriend, Olivier Martinez, is from. Looks like that’s not the only reason!

She wants to get as far away from Los Angeles as possible, because she fears for her life, and the life of her daughter.

According to TMZ, Halle is asking a judge permission to move to France with Nahla, and her ex, Gabriel Aubry is trying to block it.

We’ve learned there have been and are serious threats to Halle’s life and she feels the move is a life or death situation.

Law enforcement sources tell us … Robert Hoskins, a mentally unstable man, escaped from a mental institution last week.

We’ve learned he has made threats against Halle’s life — specifically to “slit her throat.”

Hoskins is no stranger to the law — he has threatened to slit Madonna’s throat in the past and was actually shot by her bodyguard in 1995 after he trespassed onto Madge’s property.

And as we first reported, another stalker who recently trespassed onto Halle’s property multiple times has just been released from jail.

Friends of Halle tell us … she is particularly concerned because Starmaps and some Hollywood bus tours literally take tourists to her doorstep.

And Halle’s friends say … the actress is very concerned that baby daddy Gabriel Aubry is parading Nahla in front of paparazzi almost daily and possibly putting her in harm’s way.

Bottom line — Halle’s M.O. for wanting to move is rooted in security … not revenge.

I can see both sides. If I were Halle, I’d want to get the hell out of dodge too, but France? Really? I mean she could probably move to Portland (I hear it’s beautiful this time of year) and it would have the same effect, as far as a stalker is concerned.

Amidst the rumors that he’s been charged with child endangerment due to an alleged scuffle he had with his daughter’s nanny while Nahla was in her arms, Gabriel Aubry was spotted taking Nahla to pre-school this morning.

According to TMZ, Halle Berry is trying to get a court to take away all of Gabriel’s custody rights until the child endangerment investigation has completed.

Gabriel claims that he never put his hands on the nanny but that she tripped as she was backing out.

Back when Halle Berry and Gabriel Aubry split, it quickly got nasty, with both parties hurling accusations against the other. So many things were being thrown out there that it was hard to see through all the muck. Halle accused Gabriel of being extremely verbally abusive, which included calling her the N-word. Gabriel claimed that Halle was neglecting their daughter, Nahla, to work on her movies. So many stories hit the press, that it was really hard to pick sides, because who knew who was telling the truth? Well, by the looks of this new revelation, it sounds like Halle might not have been lying all along.

Halle Berry is going to court this AM, and she’ll ask a judge for an order prohibiting her baby daddy, Gabriel Aubry, from having ANY contact with 3-year-old Nahla until the child endangerment investigation against him is resolved.

As TMZ first reported, the LAPD is conducting a criminal battery and child endangerment investigation after Gabriel allegedly pushed the nanny with Nahla in her arms. And before the alleged pushing, the nanny says Gabriel screamed at her and hurled a racial epithet. In addition, we’ve learned the L.A. County Dept. of Children and Family Services is also conducting a child endangerment investigation.

TMZ has learned more about what nanny Alliance Kamdem has told the cops. Law enforcement sources tell us … Kamdem claims Gabriel repeatedly yelled and cursed at her, often while Nahla was present. Kamdem also says it got so bad … Gabriel would make her sit in a corner in his condo until he called for her.

Kamdem also claims Gabriel often yelled at Nahla, causing the child to cower and cry. And she told police… when Nahla had a rash he refused to treat it.

Kamdem quit last week after Gabriel allegedly shoved her.

Gabriel’s rep tells TMZ, “Anyone can file a police report at any time, regardless of it being accurate.”

No matter what – at the end of the day – there’s a child in the middle of all this. If Gabriel truly is as nasty as Halle and the nanny have said, then he’s not fit to be a father. Hopefully for Nahla’s sake this is worked out soon!

Halle Berry stopped by the Sweet Lady Jane bakery to pick up a birthday cake for her fiance, er, boyfriend Olivier Martinez.   Olivier celebrated his 45th birthday yesterday.

Still no official word on the engagement.  Also, forget that engagement ring nonsense – show us the cake!

Your wedding invite isn’t in the mail.  According to TMZ, the ring that Halle Berry is sporting is NOT an engagement ring. It is a gift from her boyfriend Olivier Martinez, but he has not proposed.

sources connected to the couple tell us … as of last week, Halle and Olivier Martinez were not engaged.  Our sources say Olivier did indeed give Halle the ring as a gift, but it positively is not a symbol of getting engaged.

Halle and Olivier are in a “committed relationship” and marriage “could be in the cards,” but as of last week — when the photo came out — they were not engaged.

Why not just have your rep issue a short and sweet statement then? I suppose it’s great publicity even if it’s false, right? And they can’t spend their days hitting back at every rumor….

Despite arguing that she’d never marry again, Halle Berry is engaged to her boyfriend Olivier Martinez!

According to US Weekly, Olivier popped the question over the holidays with a beautiful emerald and diamond ring.

But Martinez will not only gain a wife when the pair walk down the aisle, but also Berry’s 3-year-old daughter, Nahla — who’s father is Berry’s ex-boyfriend, Gabriel Aubry. Berry and her husband-to-be first locked eyes when they worked as co-stars on the film “Dark Tide” (which is set to be released later this year) but things didn’t get romantic until 2010.

This is the third marriage for Berry who was previously hitched to baseball player David Justice for four years and singer Eric Benet for two years before separating.

Last week, rumors of the pair’s engagement caught wind when Berry was spotted with a new bauble on her ring finger — although at the time, neither Martinez nor Berry’s reps confirmed their engagement.

Third times a charm? Hopefully it works out for Halle this time.

Even though Halle Berry swore off marriage following her divorces from David Justice and Eric Benet, looks like she might have had a change of heart!

Third times the charm? The 45-year-old Oscar-winner was spotted wearing a gorgeous new ring on her wedding finger over the last couple days.

The actress sported a gold ring with a large emerald stone in the center as she enjoyed New Year’s Day with her family in Malibu.

If the pair, who have been dating since filming unreleased thriller Dark Tide at the end of 2010, have become engaged then it means Halle has changed her opinion about the virtue of marriage.

If her beau Olivier Martinez has decided to make an honest woman of Halle, it seems to have happened over Christmas.

The Monster’s Ball favourite was first spotted with the ring on December 29 as she enjoyed a romantic date with the French hunk.

In 2009 she said: ‘I will never, never get married again.

‘I’ve come to a place now where I think two people can share their lives without the ring, without the piece of paper.’

Wonder if she did get engaged?
