TMZ has exclusively learned that Lane Garrison drank “several shots” of Grey Goose vodka at a party before driving a Land Rover that crashed in Beverly Hills, killing 17-year-old high school student Vahagn Setian and injuring two 15-year-old girls. This contradicts the account of Harland Braun, Garrison’s attorney, who told TMZ that the “Prison Break” star had consumed only one drink at the party, and that he doubted that Garrison was intoxicated when he took the wheel.

Five eyewitnesses from the party tell TMZ that Garrison arrived at the party with Setian and two women, whom he had met earlier at a gas station. They say Lane brought a bottle of Grey Goose vodka to the party and unveiled the bottle to the crowd with a flourish. The gathering was described by several attendees as a “kick back of around 30 people.” The eyewitnesses, all acquaintances of Setian, say that Garrison then started taking shots of the vodka and offering shots to other partygoers. Several eyewitnesses also said photographs were taken of Garrison consuming alcohol.

Later in the evening, when the alcohol at the party was running low, the eyewitnesses say that Garrison agreed to drive out to buy more, and took Setian and two girls with him. Four hours elapsed, they say, before they became concerned and drove out to look for Garrison, Setian and the young women. After discovering the accident, they then drove to Cedars-Sinai Medical Center, where they learned that Setian had died.

Attorney Harland Braun tells TMZ that ultimately the results of Garrison’s blood alcohol test could tell the story. The results of that test are two weeks away.

BRITNEY Spears‘ wild and crazy nights with new pals Paris Hilton and Brandon “Greasy Bear” Davis have caught the eye not only of her concerned fans and the public – but also of the Los Angeles Department of Children & Family Services.

A source close to the singer said, “The department has been calling Britney trying to set up a meeting with her, so they can check on [Spears' baby sons Sean Preston and Jaden James]. The calls started after this recent bout of bizarre public behavior.”

But they are not the only ones worried about Spears.

Her family is aghast at her all-night partying with Hilton and Davis and were mortified when, on four separate occasions, Spears was shot by paparazzi not wearing any underwear.

The family source said her mother, Lynne, “is very disturbed and has been trying to get a hold of Britney, but she can’t. Lynne, Britney’s brother, Brian, and her dad, Jamie, are very upset and are trying to stage an intervention with [Spears' manager] Larry Rudolph’s help.”

A rep for the Department of Children & Family Services in L.A. didn’t return calls.

But it wouldn’t be the first time the family service agency’s social workers paid a visit to Spears. On April 8, representatives for the department, along with the L.A. County Sheriff’s office, went to the Malibu home Spears shared at the time with hubby Kevin Federline after Sean Preston fell from a high chair and hit his head while he was under the care of a nanny.

Another friend of Spears said it is possible the department is now merely following up on that original visit. But the Spears household has probably become even less stable since April.

Three different times, Britney has checked into L.A. hotels like the Viceroy with Hilton, rather than go home to her sons, who are presumably being watched by her mother.

Us Weekly reports that father Jamie recently had a stern talk with his Britney. The magazine notes, “He was not happy with her antics . . . He told her that she’s a grown woman and needs to act like one, and she’s been making bad decisions.”

TMZ has learned that “Prison Break” star Lane Garrison has hired powerhouse defense attorney Harland Braun in connection with last Saturday’s fatal car accident.

Lane was at the wheel in his Land Rover on Saturday night when it crossed a median in Beverly Hills and crashed into a tree. A 17-year-old boy sitting in the backseat was killed and two 15-year-olds were injured. Braun tells TMZ that Garrison had never met the three teenagers before the night of the accident. Braun says Garrison was at a local supermarket earlier in the evening when the trio recognized him in the checkout line and asked him if he wanted to go to a party. Braun says Garrison went to the party and had one drink.

Braun says Garrison also had one margarita at a Mexican restaurant that night, but that was the extent of his alcohol consumption. Braun tells TMZ that as Garrison was leaving the party to meet a woman at his apartment, the three teens asked to accompany him. Braun says Garrison has no recollection of the accident, which Braun says rendered him unconscious. In fact, Braun claims Garrison’s first memory was waking up at the Century City Hospital emergency room with a taxi coupon on his lap that had been given to him by hospital staff so he could get home.

Braun says he was not told by hospital personnel that someone had died. He learned of the death later from a friend, Braun says, and was “totally despondent.” Braun says a sample of Garrison’s blood was taken at the hospital, but it could take several weeks before the results are in. Braun says he doubts Garrison was intoxicated, but also says, “Who knows if someone put something in his drink at the party.”

Braun also says Garrison’s Land Rover had been experiencing alignment issues as of late and had been pulling to one side, and added that the SUV had brake problems. Braun says he is forwarding repair receipts to the police.

According to Braun, “Nobody knows what happened, it’s a mystery.”

Hollywood photo agency X17 is suing snarky gossip blogger Perez Hilton aka Mario Lavandeira, for copyright infringement. The agency claims Perez used their images on his website “without permission from the agency, thereby violating federal law.”

The tabloid agency is seeking over $7.5 million dollars in damages from Perez for what they say is a loss of profits and injury to their reputation. The photo agency believes their pics have played a large part in the success and profitability of perezhilton.com, which reportedly charges between $9,000 and $16,000 a week for ad space. It costs plenty to appear next to Britney’s crotch!

Perez tells TMZ, “I have yet to be personally served with this lawsuit. My lawyers and I will address the situation when we have the opportunity to review the materials.”

The self-proclaimed “Gossip Gangsta,” who calls a local L.A. coffee shop his “office,” is currently scheduled to appear on the upcoming “Big in ‘06 Awards” on VH1, and on MTV’s New Year’s Eve special.

Actress Tawny Kitaen has been charged with felony drug possession after sheriff’s deputies said they found cocaine in her San Juan Capistrano apartment. Authorities say deputies responding to a request for a welfare check in May found 15 grams of cocaine in Kitaen’s apartment. Authorities say her two children were home at the time, and Kitaen had given deputies permission for the search. Kitaen was arrested in 2002 on charges she abused then-husband, former Angels pitcher Chuck Finley. She agreed to anger management and conflict resolution counseling in exchange for the dismissal of two misdemeanor counts of spousal abuse. Kitaen is best known for her role opposite Tom Hanks in the 1984 comedy “Bachelor Party” and VH1’s “The Surreal Life.”

NEW YORK (AP) — After a firestorm of criticism, News. Corp. said Monday that it has canceled the O.J. Simpson book and television special “If I Did It.”

“I and senior management agree with the American public that this was an ill-considered project,” said Rupert Murdoch, News Corp. chairman. “We are sorry for any pain that his has caused the families of Ron Goldman and Nicole Brown Simpson.”

A dozen Fox affiliates had already said they would not air the two-part sweeps month special, planned for next week before the Nov. 30 publication of the book by ReganBooks. The publishing house is a HarperCollins imprint owned — like the Fox network — by News Corp.

In the projects, Simpson speaks in hypothetical terms about how he would have committed the 1994 slayings of his ex-wife Nicole and her friend Goldman.

Relatives of the victims have lashed out at the now scuttled publication and broadcast plans.

“He destroyed my son and took from my family Ron’s future and life. And for that I’ll hate him always and find him despicable,” Fred Goldman told ABC last week.

The industry trade publication Broadcasting & Cable editorialized against the show Monday, saying “Fox should cancel this evil sweeps stunt.”

One of the nation’s largest superstore chains, Borders Group Inc., said last week it would donate any profits on the book to charity.

Simpson was acquitted in 1995 of murder in a case that became its own television drama. The former football star and announcer was later found liable for the deaths in a wrongful death lawsuit filed by the Goldman family.

Judith Regan, publisher of “If I Did It,” said she considered the book to be Simpson’s confession.

The television special was to air on two of the final three nights of the November sweeps, when ratings are watched closely to set local advertising rates. It has been a particularly tough fall for Fox, which has seen none of its new shows catch on and is waiting for the January bows of “American Idol” and “24.”
