Sofia Vergara is engaged to be married to True Blood hunk Joe Manganiello next month, but apparently her legal battle with her ex-fiance Nick Loeb is still waging on. When they were still together, Sofia and Nick had some embryos frozen, but didn’t feel that it was the right time to have children. Since they’ve called time on their relationship, he has filed a lawsuit asking for the right to have the embryos implanted in a surrogate so that he could have their children. Since they are no longer together, she filed a motion to dismiss his case, stating that they both previously said that they would have to agree on the unfreezing – and she doesn’t.
During a Tuesday hearing, Vergara’s lawyers brought up a section of the penal code that states that if someone uses genetic material from another person without consent, it’s a criminal offense. But the judge shot down Vergara’s argument and allowed Loeb’s team to move forward with the civil case.
Vergara’s team will have another chance to challenge the case before it heads to trial.
The suit, which was filed as “Doe v. Doe,” also alleges that Vergara was “physically, emotionally and mentally abusive to” Loeb.
