Halle Berry and Olivier Martinez filed dueling divorce papers

Yesterday, the news broke about Halle Berry’s divorce from Olivier Martinez and now little details are escaping as to what happened and how things are being handled in the aftermath.

It appears that Halle filed her papers first – using fake names for each of the parties involved. Shortly thereafter, Olivier filed his own papers. They have both cited irreconcilable differences in their documents and have listed their official date of separation as Monday.

One source said that their relationship “just ran its course”, while another said that they “eventually realized they were more different than they first thought.”

In a joint statement, the former couple said, “It is with a heavy heart that we have come to the decision to divorce. We move forward with love and respect for one another and the shared focus for what is best for our son. We wish each other nothing but happiness in life, and we hope that you respect our, and most importantly our children’s privacy, as we go through this difficult period.”

Both parties are seeking joint custody of their two-year-old son Maceo, while Halle wants to spousal support for either party. She also asks for the costs of raising their child to be shared per the terms of their prenuptial agreement. Olivier has also asked that the spousal support issue be tackled at a later time. She states in her papers that she wants all of her earnings and assets as part of their prenup.

Halle attached a form to her documents regarding visitation with their son. It says that they will “share custody as is in the best interest of the child” but that Olivier should provide transportation to and from visits and that he’ll need permission before he takes their son out of the state of California.
