‘Glee’ actor Mark Salling has been sued by a former ex-girlfriend, who claims he committed sexual battery. In her lawsuit, Roxanne Gorzela claims the actor committed sexual battery by forcing her to have sex without a condom.

She claims the two began dating in September 2010, and in March 2011 she agreed to have sex with him, but only if he used a condom. Apparently Salling ignored her request, and went on to “insert his penis into her vagina without a condom.” Gorzela says she protested, and he stopped, but then started a second time, again without a condom.

Gorzela proceeded to call and text Salling to ask if he had been tested for STDs, according to E! News. He failed to return her messages, so she went to his house to confront him. When she demanded he prove he had no STDs, he reportedly grabbed her and pushed her to the ground, causing her to hit her head. She filed a police report on March 25, the day of the alleged attack.

The young woman filed the sexual battery lawsuit against Salling on Friday afternoon in Los Angeles court, according to E! News. In addition to sexual battery, the “Glee” star is accused of intentional infliction of emotional distress and negligence. The suit calls the actor’s behavior “willful, malicious and despicable,” adding that it caused Gorzela “severe and substantial mental and emotional distress, humiliation, fear, apprehension, anxiety and anguish.”

The actor’s publicist has denied the allegations against her client. “There is no truth to this. It’s the textbook case of a disgruntled girl looking to cash in on a TV star’s success,” she told TMZ in a statement. “We turn the rest over to Mark’s attorneys and have no further comment.”

Salling has played “Puck,” the bonehead jock chorus singer, since Season 1 of the hit Fox series. In 2011, he was nominated for the Teen Choice Award for Choice TV: Scene Stealer Male.

If she’s telling the truth, then that is pretty disgusting of Mark. GROSS. I can’t imagine how people these days have sex without condoms. I’ve been happily married for 13 years, so I don’t have to worry about it (thank God). But if I were single, I’d be a FREAK about condoms. You just never know these days – who has what. Who’s being honest, who’s not. You just can’t trust anyone. Your partner should be the one person you CAN trust – you shouldn’t have to argue about wearing protection. If this is true, then shame on him.
