Dina Lohan experienced every mother’s worst nightmare on July 6 when she watched her daughter Lindsay in an LA courthouse, fighting through tears as she was sentenced to three months in jail. “We were all in shock,” Dina tells In Touch of the sentencing — the result of Lindsay’s failure to attend court-ordered alcohol education classes while she was in Cannes for a film opening. “The judge basically threw the book at her.” While many mothers might feel remorse, Dina only seems to feel anger at a system that she believes persecuted Lindsay for being “in the public eye” and at her ex-husband Michael, who claims Lindsay still has substance abuse problems. “She’s not drinking, and she’s wearing an alcohol monitoring bracelet on her ankle,” Dina says of Lindsay, who has been in rehab three times. In an exclusive interview, In Touch asked Dina all the toughest questions about Lindsay’s case and revealed deep fears that the experience could destroy Lindsay.
How does Lindsay feel about going to jail?
When the decision came down, it was horrific. We hugged and cried a lot. But we’re optimists. Lindsay is sober and she’s fine. I don’t want to speak hypothetically [about jail] because she’s not going to be in that situation.
When people say, “What did you do for her, Dina?”, how do you respond?
She went to rehab before the court ordered her. When I put my daughter in rehab, I knew she needed it. In 2007 — not currently.
Is Lindsay 100 percent sober now?
Yes.
What is she the most scared of about jail?
She is claustrophobic, so she’s in fear of that.
What are you most scared of?
If Lindsay went to jail, I would fear for her life. Jail doesn’t help anyone no matter what problem you have — unless you’re a rapist or a murderer. This wasn’t a violent crime, but they’re saying you miss a DUI class and have to go to jail for three months — that’s absurd
This movie looks so good! I love Zach Galifianakis…he’s hilarious!

“I am so sorry for Lindsay Lohan,” Joan tells THE INSIDER. “I am so appalled that these people are coming out of the woodwork upset that I did a joke about her. I think they should worry about Lindsay Lohan. I think this ex-girlfriend, this deejay — I thought it was a skinny boy when I first saw the picture — came out doing jokes about me and Melissa [Rivers, Joan's daughter]. Why not worry about Lindsay Lohan? That girl is going to be dead in 10 years if somebody doesn’t take care of her.”
She goes on to say, “If I were Lindsay’s parents, I wouldn’t be on television discussing it, I wouldn’t be going on to Joan Rivers for doing a stupid joke on her blog, I would be taking her to rehab and a rehab where you don’t get your nails done.”
Joan, whose new WE tv series, “Mother Knows Best?,” premieres in December, shows her serious concern for the troubled young actress, saying that if Lindsay’s family “can’t scrape it together” to pay for rehab that she and Melissa will pay for it. “I think it is so sad, the road that this girl is going down, it’s appallingly sad and I think somebody should, Melissa and I will pay for rehab if her family can’t scrape it together. She better get into rehab and better get into it fast.”
Joan’s plea to Lindsay? “Lindsay, I am pleading with you… you’re beautiful, you’re smart, you’re talented. Go to rehab, you’re young! Melissa [and I] will pay for your rehab!”
