Burn Notice star Jeffrey Donovan might want to rethink his defense by the time he goes to court for his July 12 DUI case, as the reasoning, “I really think I’m only borderline and not too drunk” probably won’t get him too far.TMZ relates Jeffrey’s unique defense, outlined in a police report from Miami Beach PD. The arresting officer wrote he first noticed Jeffrey after he heard “a loud tire screech” behind him, and saw the actor’s car swerve to avoid hitting him. When he stopped, he told the cop, “Sorry, I didn’t see the red light or your stopped car.”
The officer smelled alcohol and asked Jeffrey if he’d been drinking.
“I had three drinks at the Fontainebleau,” Jeffrey responded, before failing a field sobriety test. As he was taken into custody he added another gem: “The only mistake I made tonight was drinking Benadryl with 3 glasses of wine.”

Despite word that Paula Abdul likely won’t appear on American Idol next season, fellow judge Simon Cowell isn’t worried.
“She’ll be fine. She’ll be on the show,” he tells Extra. “I don’t get a lot of say. I’ve just made it clear that I want Paula on the show.”
Added host Ryan Seacrest (who just inked a $45 million, three-year contract): “I think as far as I know, you’ll see everybody back. I hope so.”
David Sonenberg, Abdul’s manager, raised concern over the weekend, telling the Los Angeles Times that the singer-dancer hasn’t been offered a contract yet.
“She’s not a happy camper as a result of what’s going on. She’s hurt,” he told the paper.
Meanwhile, a grass-roots “Keep Paula” campaign has launched on Twitter to keep Abdul on the show.
Matt Giraud, Anoop Desai and Danny Gokey — who are now on the Idol live tour – are among the alums who’ve taken time out to join the campaign.
Over the weekend, Abdul took to her Twitter page to thank fans for standing by her.
She wrote: “I”m actually moved 2 tears upon reading the enormous amount of tweets showing me your kindness, love & undying support. God bless all you! If it weren’t for you, this specific time and situation would feel a lot worse! XoP”

It’s been nearly a year since their fairytale wedding, but Beth Ostrosky is still in the Honeymoon phase with her radio host hubby, Howard Stern.
“I highly recommend marriage. It’s better than I ever imagined it would be!” the former model told In Touch at the 2009 Mercedes-Benz Polo Challenge’s opening day in Bridgehampton, New York on July 18.
Though the couple has been together for years, Beth swears she has no secrets to keeping the sizzle in her relationship. “If it works, it works. If it doesn’t, it doesn’t. We just seem to work,” the blonde beauty added. They may not have any plans yet for their first anniversary on October 3, but take note Howard- Beth expects more than paper! “He can do better than that!” she laughed.

Looks like things are getting mighty steamy in Bella’s truck! In a just-released still photo from New Moon, Kristen Stewart – as Twilight’s beloved heroine – cozies up to teen hunk Taylor Lautner, who plays Jacob Black.
In the Twilight sequel, Bella turns to best bud Jacob to lick her wounds after her vampire love Edward (played by Robert Pattinson) flees Forks, Wash., in the hopes of giving her a normal life. But as Bella grapples with her not-so-platonic feelings for Jacob, he transforms into a werewolf.
The supernatural romance unfolds this fall when New Moon opens Nov. 20.

A flavor of what Michael Jackson fans would have seen at his summer concerts in London could be coming to the big screen.
A deal is underway to make the best of some 80 hours of Jackson rehearsal footage into a movie. Before his sudden death on June 25, Jackson was preparing to perform up to 50 shows at the O2 Arena beginning July 13.
According to Variety, Sony Pictures is in talks with AEG Entertainment to acquire the rights to the footage of his rehearsals, and High School Musical director Kenny Ortega will direct. Ortega was designing and choreographing the “This Is It” shows with Jackson.
Also reportedly included in the film would be a new version of Jackson’s iconic Thriller, which was in the works. The video remake – possibly in 3D – was part of the ambitious plans that the promoters AEG Live and Jackson had for the 50-date concert series.
Variety also reports that AEG is also gearing up to sell rights to Jackson’s memorial concert on August 29 – the day that would have been Jackson’s 51st birthday.
AEG reps in the U.K. had no immediate comment.
